Guest Rental Agreement & Contract
Once we have processed your reservation, we will send you a Guest Agreement specific to your Vacation Rental Property and the dates of your stay with us. We require a signature to the Adobe Sign document to let us know that you have read and agree to the terms and conditions of the Guest Agreement and ask that you send us a copy of the front of your driver's license. We will give you specific instructions on how to do this in a secure manner. A guest list with the names and ages of all staying at the property is also required.
Guest is required to provide credit card number as a guarantee. Guest agrees to pay all rent and fees associated with rental, accept all terms of the lease agreement and accept all liability for any damage beyond normal wear and tear (or Accidental Damage Protection) during the term of the lease with Georgia Mountain Rentals. If Guest fails to do so, the Guest understands that these costs will be charged to the credit card on file and all credit card sales are final.
Reservations cancelled 14 days prior to arrival will receive a full refund less a cancellation fee in the amount of $34.50. All cancellations must be in writing for both the protection of the Guest and to confirm that the cancellation is being requested by the person who made the original reservation. All cancellation’s made after the 14 day time period of arrival will result in all loss of monies, unless Trip Insurance has been purchased. Reservations made through OTAs (Vrbo, Airbnb, etc.) will have a different cancellation policy. Please refer to their individual cancellation policies and Trip Insurance if purchased.
We cannot guarantee any road surface conditions. Roads in our area are well maintained, but most are gravel, and some are steep and curvy. Some properties have gravel driveways or roads. Please inquire with the office if you are on a Motorcycle. We can help with the best choices of properties with paved roads. Winter road conditions and maintenance are not guaranteed. WE DO NOT REFUND MONIES DUE TO ROAD CONDITIONS. You are responsible for your transportation. Georgia Mountain Rentals cannot provide transportation and is not responsible for any towing charges Guests may incur during a stay.
RENTAL PROPERTIES ARE FOR FAMILY VACATIONS ONLY
Georgia Mountain Rentals gladly rents to families or responsible adult guests who are all 21 years of age or older. For properties listed “Luxury” the minimum age for all guests are 25 years of age or older. Georgia Mountain Rentals has a "No-Group" Policy which includes but is not limited to the following: SCHOOL, SPRING BREAK, PROM, GRADUATION, SORORITIES, FRATERNITIES AND OR WEDDING RECEPTIONS. Georgia Mountain Rentals will not enter into a Rental Agreement with anyone under the age of 21. Be honest! The best way to avoid problems during your stay is to be up front when making the reservation. Any such misrepresentation, overcrowding, exceeding parking capacity, or sub-letting of Rental Property will result in both the forfeiture of all monies paid (including all fees) and immediate, expedited eviction. In addition, Georgia Mountain Rentals reserves the right to bill $150 per incident for neighborhood complaint calls made to the police or complaint calls to GMR after hour’s emergency number, or any other neighborhood complaint regarding Guest noise, nuisance, and parties. Georgia Mountain Rentals HAS A ZERO TOLERANCE POLICY FOR ROWDY GROUPS-PLEASE BE A GOOD NEIGHBOR.
MAXIMUM OCCUPANCY & PARKING CAPACITY
Georgia Mountain Rentals has set and published occupancy & parking limits for every unit and strictly enforces these limits. The Maximum Occupancy is determined by the bedding provided in the Rental Property and/or the limit set by Georgia Mountain Rentals and the Owner of the Rental Property. The number of available off-street parking spaces determines the Parking Capacity. If additional guests will be occupying the property, and are approved by Georgia Mountain Rentals and Property Owner, additional charges will be required. Absolutely No House Parties, events, receptions, kegs and overcrowding are not permitted. Georgia Mountain Rentals represents a few properties which will allow a small family gathering. NO RV's allowed on ANY Georgia Mountain Rentals property per city ordinance. Parking is permitted only in designated spaces, not along the street or on neighboring properties. Parking violations will be subject to a fine of $50 per vehicle per occurrence.
RIGHT OF ENTRY
Guests agree that the Georgia Mountain Rentals Agents reserve the right to enter the rental property anytime to investigate disturbances, check occupancy, check for damage, deliver household items, or have a scheduled service carried out to make such repairs, alterations or improvements.
A material breach of this Agreement by Guests, which, in the sole determination of the Agent, results in damage to the Premises, personal injury to Guests or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guests' rental period. Violation of any of the rules contained herein will result in IMMEDIATE EVICTION and forfeiture of rent and security deposit (where applicable). If the rental period created hereunder is for 30 days or less, the expedited eviction procedures set forth in the Cabins Act will apply. Guests may be evicted under such procedures if Guests: (i) hold over in possession after Guests rental period has expired; (ii) commit a material breach of any provision of this Agreement that according to its terms would result in the termination of Guests' rental period; (iii) fail to pay rent as required by this Guest Agreement, or (iv) have obtained possession of the Premises by fraud or misrepresentation. Any reservation made under false pretenses will result in forfeiture of advance payments and the party will not be permitted to check-in. Georgia Mountain Rentals reserves the right to refuse service to anyone. All rental properties are leased without regard to race, color, religion, sex, national origin, handicap or sexual orientation.
FIREWORK AND FIREARMS
The use of firearms and fireworks is strictly prohibited in and on all Georgia Mountain Rentals properties. The towns of Helen, Sautee Nacoochee, Clarkesville, Hiawassee, Dahlonega and Tiger have strict regulations & fines regarding fireworks.
Georgia Mountain Rentals cannot refund monies or relocate Guests due to malfunctions in equipment, such as TVs, VCRs, DVDs, gas log fireplaces, jetted tubs, hot tubs, pool tables, gaming systems, small appliances, etc. No refunds will be issued for early departures. No cash refunds are available. Refunds will not be issued for any inclement weather conditions. In the event of conditions such as snow or ice preventing access to the vacation rental property, Guests will be given the option to reschedule their vacation within six (6) months of the original reservation dates. Any charges or refunds for moving dates, adding nights or changing vacation rental properties will only be processed using only the credit card on file.
Guests are required to leave the property in the same general condition in which it was found upon arrival. Georgia Mountain Rentals requests that dishes be cleaned and put away. All food should be removed from the refrigerator and cabinets. All garbage must be put in garbage cans and not left scattered around the cabin. Furniture must be placed in its original location. Georgia Mountain Rentals requests that dirty linens and towels be placed in a bathroom tub or shower. If additional cleaning is required, appropriate fees will be charged to the credit card on file. Guests are responsible for any damages or abuse resulting in excessive cleaning requirements. Guests are responsible for any loss to the property or its contents by any member of the party during occupancy. Georgia Mountain Rentals' Agents walk through each property after Guests' departure to ensure the property is left in good order. Agents will make the final determination of any additional charges to the Guests.
Hot tub rules are clearly posted and these rules must be adhered to at all times. Hot tubs are cleaned prior to each Guest's arrival. There is a $35.00 fee if a Guest requires an additional cleaning of the hot tub during their stay. Guests will be charged additional fees if bodily fluids or food are left in hot tub. Hot tub covers are for insulation and heating purposes and are not designed to support a person or persons. Do not sit on the hot tub covers. Guests will be charged a replacement fee for those hot tub covers that are damaged during their renting of the property.
Hot tubs are not to be used as swimming pools. Hot tubs are used for relaxation purposes and should never be used for more than fifteen minute intervals. Women who are pregnant, or think they may be pregnant, should not use the hot tub. Children under twelve years old, any one with heart conditions or any other health issue should NOT be in the water with a temperature higher than 98° F for more than fifteen minutes at a time. Excessive heat in the hot tub can cause damage to an unborn baby, collapsing of heart valves in young children, strokes and heart attacks to anyone with an existing heart defects. Children under the age of eighteen should not be left unattended or without adult supervision while in a hot tub. The temperature should never be set over 104° F. PETS ARE NEVER ALLOWED IN A HOT TUB. The chemicals and excessive heat in the hot tub from overuse can cause skin and eye irritation, rashes, fever and ear infections. Georgia Mountain Rentals and the property owners are not responsible for any injuries, accidents, medical issues or medical bills. All guests will use the hot tub at their own risk and discretion. Please use caution.
All of the vacation rental properties are individually owned with Georgia Mountain Rentals having no ownership interest. Each property reflects the taste of each owner. We cannot be held responsible for any changes made by the owners in furnishings or amenities supplied. Rental Guests understand and agree that we accept families and responsible adults over the age of 21 years of age only. Our luxury properties require that responsible adults renting are over the age of 25. Georgia Mountain Rentals reserves the right to not accept any Fraternities or Sororities as Guests in any property.
Guests also agree that the premises shall not be occupied by more than the number of people stated on the reservation. If the unit is occupied by more than the number of people stated at the time of check-in, an additional fee will be charged or guest will be asked to leave. Guests staying or visiting the property shall not offend or disturb neighbors in any manner. The use of firearms or fireworks is strictly prohibited. No drinking ALCOHOLIC BEVERAGES by persons under the legal age of twenty-one (21) is allowed on or in any property. Should Guests or visitors of Guests be arrested for underage drinking at the rental property, this rental agreement shall be terminated and the Guests will be evicted. If Kegs are found on properties it will result in immediate eviction. Illegal drug use is strictly prohibited. Quiet time is from 10 pm till 9 am.
*All luxury properties are available to responsible adults over the age of 25.
There are NO check-ins on December 25th at Georgia Mountain Rentals.KEYS & ELECTRONIC LOCKS
For those properties with key locks, keys must be returned to the lock box at the time of check-out. Guests are issued one set of keys at check-in. As our properties are privately owned, the Guests are responsible for any lost keys. In the event that keys are lost and the property must be re-keyed, the Guest will be responsible for the cost of this procedure.
For those properties with electronic locks, confirm that the door is locked and the property is secure at the time of check-out.
Fireplaces are seasonal and are non-operational yearly from May through September. Firewood is not provided for cabins with wood burning fireplaces, stoves or outdoor fire pits. Firewood may be obtained from many local markets at reasonable rates. Most of our cabins are equipped with gas logs. The gas logs are NOT to be rearranged for any reason! NO ONE IS ALLOWED TO CHOP OR DESTROY ANY TREES OR SHRUBS ON THE PROPERTY. DOING SO WILL RESULT IN A $500 FINE.
Codes for electronic gates will be issued on the day of arrival between 3 and 4 pm. All electronic gates are timed in such a way that only one vehicle at a time should attempt to enter or exit. Guests who cause damage to the gate will be held liable for repair.
Smoking is not permitted inside. Failure to obey this rule will result in an additional charge to Guest's credit card in the amount of $200.00.
Guests acknowledge that NO PETS are allowed in or on the premises unless approved by Georgia Mountain Rentals. Some vacation rental property owners will not allow pets in their home. For those holiday homes that are pet-friendly, the cost per pet is $75 for the first pet and $25 for each additional pet. All pets should be listed on the reservation. If a pet is left in a property alone, they must be kept in a crate or kennel. Guests with an UNAUTHORIZED pet on the premises will result in eviction and loss of all rental fees. NO pets are allowed on the furniture. If housekeeping find that pets have been on the furniture there will be an additional $50 charge for cleaning. All pets need to be picked up after both inside and outside of the property. If guests do not clean after their pet(s) there will be an additional $100 charge for cleaning. Please confirm that your pet is on a flea prevention program.
MoonDoggies is a pet-sitting company located near the Georgia Mountain Rentals office. If you would like to contact them about overnight or day care, call 954-295-9122. We highly recommend them.
Service animals are only dogs. They can be any breed and any size of dog and are trained to perform a task directly related to a person's disability. Guests with a service animal will be asked two questions allowed by ADA. "Is the dog a service animal required because of a disability?" "What work or task has the dog been trained to perform?" Guests with a service dog are invited to choose the property that will best suit their needs.
Pets who provide emotional support, well being, comfort or companionship are not recognized as a service animal under ADA regulations. Guests with an emotional support animal will be asked to choose only from those properties that are designated as pet friendly. The same pet fees apply as mentioned under the PETS category above for emotional support animals.
WHAT WE SUPPLY
A basic supply of linens, towels, paper towels, soap, makeup removing wipes, shampoo with conditioner packets, dish detergent, toilet tissue and trash bags is provided in each property. Bed linens and bath towels are not changed during your stay. The startup set of soap, makeup removing wipes, toilet tissue, paper towels and trash bags is not replenished; we suggest you bring extra items for longer stays. Georgia Mountain Rentals accounts for all linens and towels provided in each unit. Any missing, damaged or stained beyond repair items will result in additional charges to the Guest.
Reservations for properties with one to three bedrooms are charged a flat rate $40 Damage Waiver that covers ACCIDENTAL DAMAGES to the property up to a total of $750.00. Reservations for properties with four or more bedrooms are charged a flat rate $70 Damage Waiver that covers ACCIDENTAL DAMAGES to the property up to a total of $1,250.00
LOST & FOUND
We make every effort to locate and return lost items, but will not be responsible for things you leave behind and that we cannot find! When you leave something behind, call Georgia Mountain Rentals and we will alert housekeeping of the missing item(s). If found we will have it shipped to you at your expense. Lost and Found items unclaimed after 30 days will be turned over to local charities.

Georgia Mountain Rentals Guest Service Representative will be happy to confirm all data contained herein or answer any questions regarding property details you may have prior to booking your reservation. Rates for holidays, special events, and weekends may be higher. Rates do not include tax and are subject to change. Rates, furnishings, amenities, fees, and taxes are subject to change without notice.
INDEMINIFICATION AND HOLD HARMLESS
Guests agree to indemnify and hold harmless the Owner and Agent for any liabilities, theft damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guests' use and occupancy of the rental property, including but not limited to any claim or liability for personal injury, damage or theft of property which is made, incurred or sustained by the Guests. A material breach of this Agreement by Guests, which, in the sole determination of the Agent, results in damage to the Premises, personal injury to Guests or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of all Guests. Violation of any of the rules contained herein will result in IMMEDIATE EVICTION and forfeiture of rent and security deposit.
Georgia Mountain Rentals serves as the agent & representative of all the owners of vacation properties in their rental program, and is acting at all times, in and for the best interests of the property owners.
If any part of this Guest Agreement is declared unenforceable or invalid, the remainder will continue to be valid and enforceable. Smoking in properties, and pets in non-pet properties will result in the Guest being charged a minimum fee of $200.00
The Guest hereby certifies receipt and review of Georgia Mountain Rentals Guest Agreement and further agrees to abide by all the terms and conditions, rules and regulations contained herein.
GUEST AUTHORIZATION with SIGNATURE and COPY of DRIVER'S LICENSE
I agree to pay all the rent and/or any outstanding long distance phone charges, accept all terms and conditions of the lease agreement and accept all liability for any damage beyond normal wear and tear during the term of my lease with GEORGIA MOUNTAIN RENTALS. If I fail to do so, I understand that these costs will be charged to my credit card.
I hereby give Georgia Mountain Rentals permission to charge 50% of the total nightly rate including all fees and taxes for advance online bookings, or to charge at least a $100 down payment for advance bookings secured by telephone to my credit card. I understand the balance is due 14 days before check-in.
I have read and checked the arrival and departure dates to insure that the dates of occupancy are correct. (Please note that the dates of occupancy appear on your Reservation Confirmation email.)
I have also read and agree to all terms and conditions of this Guest Agreement.
